The protected party petitioning the court to lift or modify a NCO will need to fill out a Motion to Modify/Rescind No Contact Order and file it with the Skagit County District Court.

Factors that will be taken into consideration may include, but are not limited to:
- Has the NCO been violated?
- Have there been any new law violations?
- Has the defendant completed any treatment?
- Defendant’s compliance with sentencing conditions.
- The status and nature of the criminal proceeding(s).
- Does the protected person have a safety plan in place?
- The recommendation of the prosecuting attorney.
The court will provide the petitioner (protected person) with a copy of the Judge’s order either granting or denying the motion. If granted, the court will notify law enforcement, the defendant, and the defendant’s attorney if they have one.
